On this topic, the chairman of Ayatollah Yaqubi’s office, Hujjat al-Islam Sheikh Majid al-Oboudi said, “The Iraqi society is grappling with several legal and practical problems. For example, a short visit of a child of his imprisoned father, or vice versa, is an important legal problem.”

Pointing to the rise in the number of divorces in Iraq, he said, “The cause of this increase is legal problems, and it wouldn’t happen if we attended to the religious and Islamic regulations in the past.”

He added, “The children of the broken families mostly live with the family of their uncles or under the custody of their stepmothers, and regardless of its religious problems, it has turned into a social malady.”

Saying that the only remedy to this malady is the attention to Jafari regulations, he further noted, “In accordance with religious regulations, until the father is present/alive, the custody of the male and female child should be held by the mother respectively until the age of 2 and seven.

It is necessary to note that custody is a term in jurisprudence (Fiqh) and law that means being responsible for or to bring up.
