RNA - A Muslim woman from St. Louis County claiming she was discriminated against by a potential employer, does not necessarily have an open-and-shut case.
St. Louis attorney Gonzalo Fernandez, says the security firm targeted in the lawsuit has some recourse to nullify the discrimination claim. Fernandez is not handling this case, but continues to follow it closely.
“If an employer can show…allowing an employee to follow their religious beliefs and dress as they want,” Fernandez says. “They can show that it would cause undo hardship to accommodate those religious beliefs – then it’s not a violation.”
He says the employer will have an opportunity to prove that the woman was not hired for other reasons.
The Council on American-Islamic Relations filed the suit on behalf of the woman when she said the security firm turned away her application, because she wanted to wear a Hijab at the office.
